Welcome to EFFXRT. These Terms of Service (“Terms”) govern your access to and use of the EFFXRT website, products, services, and related features (collectively, the “Services”).

Throughout these Terms, “EFFXRT,” “we,” “us,” and “our” refer to EFFXRT LLC. “You” refers to any visitor, customer, or other user of our Services.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell our products to you.

By visiting our website, purchasing a product, or otherwise using our Services, you agree to these Terms and our Privacy Policy, Refund Policy, and any other policies referenced on our website.

If you do not agree to these Terms, please do not use our Services.

1. ELIGIBILITY AND ONLINE STORE TERMS

By using our Services, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you have permission from a parent or legal guardian where required.

You may not use our products or Services for any unlawful or unauthorized purpose.

You may not transmit viruses, malware, malicious code, or otherwise attempt to interfere with the operation or security of our website.

We reserve the right to refuse service to anyone where permitted by law.

2. PRODUCTS AND PRODUCT INFORMATION

EFFXRT sells nasal strips and related products intended to support nasal airflow and serve as personal reminders of the qualities, habits, or goals a customer is working toward.

We make reasonable efforts to display our products, packaging, colors, dimensions, and other characteristics accurately. However, the appearance of products may vary slightly due to manufacturing variations, product updates, photography, screen settings, or other factors.

We may modify, discontinue, replace, or limit quantities of products at any time without notice.

All product descriptions and prices are subject to change.

3. HEALTH AND WELLNESS DISCLAIMER

EFFXRT products are consumer wellness products and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Statements associated with words such as “Patience,” “Discipline,” “Focus,” “Courage,” or other motivational language are intended as personal reminders and brand messaging. They are not representations that using EFFXRT products will produce psychological, behavioral, medical, or therapeutic results.

Our products are not a substitute for professional medical advice, diagnosis, or treatment.

If you have a medical condition, difficulty breathing, a skin condition, allergies, or concerns about whether nasal strips are appropriate for you, consult a qualified healthcare professional.

Discontinue use if you experience significant irritation, discomfort, or an adverse reaction.

Never disregard professional medical advice because of information presented by EFFXRT.

4. ORDERS

Submitting an order does not necessarily mean that we have accepted it.

We reserve the right to reject, cancel, or limit an order for reasons including suspected fraud, pricing or inventory errors, product availability, unauthorized resale, payment issues, or violations of these Terms.

If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.

You agree to provide current, complete, and accurate purchase and account information.

5. PRICING AND PAYMENT

Prices are displayed in the currency indicated at checkout.

Taxes, shipping charges, duties, or other fees may apply depending on your order and location and will be displayed when applicable.

We reserve the right to correct pricing errors, including after an order has been submitted. If a pricing error materially affects an accepted order, we may contact you before fulfillment or cancel and refund the affected order where permitted by law.

Payments are processed through Shopify and/or third-party payment providers. Your use of those payment services may also be subject to their respective terms and privacy policies.

6. SHIPPING AND DELIVERY

Shipping estimates are estimates and are not guaranteed delivery dates unless expressly stated otherwise.

EFFXRT is not responsible for delays caused by carriers, customs, weather, incorrect addresses supplied by customers, or circumstances outside our reasonable control.

Customers are responsible for providing an accurate and complete shipping address.

7. RETURNS AND REFUNDS

Returns, replacements, and refunds are governed by our Refund Policy.

Because nasal strips are personal-use products that come into contact with the skin, opened or used products may not be eligible for return except where required by law or where the product arrived damaged, defective, or incorrect.

Please review our Refund Policy before purchasing.

8. SUBSCRIPTIONS

If EFFXRT offers subscriptions, the price, frequency, renewal terms, and other applicable subscription information will be disclosed before purchase.

Unless otherwise stated at checkout, subscriptions automatically renew at the applicable interval until canceled.

You may cancel future subscription renewals using the methods provided through your account or subscription management system.

Cancellation prevents future renewal charges but does not ordinarily retroactively refund orders that have already been processed or shipped, except where required by law or otherwise stated in our policies.

9. PROMOTIONS AND DISCOUNT CODES

Promotional offers and discount codes may be subject to additional conditions, expiration dates, exclusions, and purchase requirements.

Unless otherwise stated, discounts cannot be combined.

We reserve the right to modify or cancel promotions where permitted by law.

10. INTELLECTUAL PROPERTY

All content made available through EFFXRT, including our name, logos, graphics, packaging designs, product designs, photographs, videos, text, slogans, website content, and other materials, is owned by or licensed to EFFXRT and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, sell, exploit, or use our intellectual property for commercial purposes without our prior written permission.

11. USER CONTENT AND REVIEWS

If you submit reviews, photographs, testimonials, comments, feedback, or other content to us, you represent that you have the right to provide that content.

You may not submit content that is unlawful, fraudulent, defamatory, abusive, infringing, misleading, or otherwise harmful.

Where you give us permission to use submitted content, you grant EFFXRT a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute that content for purposes consistent with the permission provided and applicable law.

Nothing in these Terms limits liability that cannot legally be limited.

To the extent permitted by law, you agree to indemnify and hold harmless EFFXRT and its affiliates, owners, officers, employees, contractors, and service providers from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another party’s rights.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer protection laws require otherwise.

The current version will be posted on this page with an updated “Last updated” date. Your continued use of our Services following an update constitutes acceptance to the extent permitted by applicable law.
